A woman, Remi has brought a divorce suit against her husband, Jide, at Grade A Customary Court, Mapo, Ibadan, Oyo State on the accounts of irresponsibility and battery.

Remi explained that Jide was irrational in his behaviour.

According to her, he forced her shop open, stole her money and packed away her goods.

She added that he burnt her clothes and forcefully took custody of their child.

Remi told the court her life was no longer safe with her husband and therefore prayed the court to end their union.

The plaintiff also pleaded for the custody of their only child because her husband had consistently failed in his responsibility towards him.

Jide denied the allegations brought against him.

Remi in her testimony said, “I moved in with my husband after he impregnated me and he made my life miserable because he never stopped maltreating me.

“He abandoned me throughout the time I was pregnant and refused to meet my needs.

“I set up a business which was doing fine and I was able to meet the home’s needs from the proceeds.

“I went to pay my other children from my first marriage a visit and my husband went irate on my return.

“I left home to sleep with a friend that night to avoid his wrath and left for my shop from there the following morning.

“My husband to my chagrin came to my shop early in the morning to beat me.

“He forced my shop open and went away with my goods worth almost half a million naira.

“He also stole the money I left in the shop.

“On returning home in the evening, I met my husband burning my clothes.

“He forcefully took our child from me and dumped him with a relative at Ogbomoso.

“My lord, I appeal to this honourable court to rule that he returned our child to me.

“I also plead with the court to make him responsible for his upkeep.

Jide in his evidence stated that, “I paid the rent of the shop my wife was using and filled it up with goods.

“She suddenly took to coming home late. I showed my displeasure at this, but she refused to change.

“I suspected she was involved in an extra marital affair, and was later proved right when I came across a picture on her phone where she was hugging another man.

“Remi deserted the home for six weeks and went to stay with her other children.

“I took our child from her when she returned and put him under my mother’s care at Ogbomoso.

“I went to her shop the following day and packed all her wares home.

The court president, Mrs S.M Akintayo, after she had heard both parties observed that their relationship had broken down irretrievable.

She thus dissolved their union and granted the plaintiff custody of their child.

Both were mandated to be responsible for their child’s upkeep, while the plaintiff was ordered to grant the defendant access to the child.
