Grade A Customary Court, Mapo, Ibadan, Oyo State, has put an end to the relationship between a couple, Abiodun and Omolola on the grounds of lack of love and care; constant fight and domestic violence by the latter.

Abiodun, who dragged his wife to court, said that Omolola apart from fighting him at home was in the habit of coming to his workplace with their children to demand for feeding allowance which he found embarrassing.

The plaintiff also told the court that he was fed up with their union because the defendant refused that he had peace of mind.

He thus pleaded for divorce and custody of their two children.

Abiodun further requested an order restraining Omolola from embarrassing, threatening and interfering with his private life.

Omolola denied all the allegations brought against her but acceded to divorce.

She however refused that her husband had custody of their children.

Omolola explained that she and Abiodun started experiencing a strain in their relationship after he accused her of infidelity.

According to her, Abiodun refused that she slept in their room and that she and their children resorted to sleeping in the corridor.

The defendant added that the plaintiff in a bid to harm her laid magun on the floor and dared that she crossed over it.

Abiodun in his testimony said: “My wife and I held an introduction ceremony and she moved in with me after we dated for months. I paid her dowry but her father returned it.

“We started experiencing differences in our marriage from the outset of it.

“My wife refused to give me the necessary attention I needed.

“I realised a few months into our wedlock that she did not love me.

“Omolola cared less about my well-being and was always ready to fight me anytime I called her attention to this.

“My wife always turned violent anytime we fought, and she would harm me.

“I give Omolola feeding allowance on weekly basis, but she would still come to my work place with our children, demanding that I give them feeding allowance in a bid to embarrass and humiliate me before my colleagues.

“I warned her against this practice but she turned a deaf ear to me.

”My lord, I have not enjoyed our marriage for a day. I am fed up with my wife and I want our union dissolved.

“I also plead that the court should grant me custody of our children and in addition restrain my wife from coming to my office to embarrass, threaten or fight me.

“I also refuse that she interfered with my private life.”

Omolola in her response said: “My husband and I started living together after he impregnated me while we were dating.

“We had our marriage ceremony, Nikkai, and naming ceremony of our child on the same day.

“He left me and our children at a point in time in our marriage to work in Lagos and he returned accusing me of infidelity.

“He became distant and cold towards me and our children.

“Three days after he came back, he sent me out of our room, and I started sleeping in the corridor with our children.

“The following morning, he laid magun on the floor and dared that I crossed over it if I was sure I was not promiscuous. I refused to give in to his request.

“I called my father on the phone and informed him of what was happening in our home.

“He instructed me never to cross over the charm and then rushed to our house. My husband got angry and insulted my father.

“Both my mother-in-law and sister-in-law also came after my father left, insisting that I cross over the charm. Our home became rowdy and they all ended up fighting me.

“Although this issue was resolved but our home no longer knew peace any time my mother-in-law came visiting.

“My lord, I am also no longer interested in our marriage.

“I pray the court to award me custody of our children, while it makes my husband solely responsible for their upkeep, giving feeding, education and health care a priority.”

The court president, Mrs. S.M Akintayo, giving her judgment stated that it was obvious that both parties were fed up with their marriage.

According to her, the defendant readily gave her consent to divorce.

Ruling, Akintayo dissolved their union and awarded custody of their two children whom she stated were still underage to the defendant.

She mandated the plaintiff to be responsible for their upkeep.

Akintayo further placed an order restraining the defendant from embarrassing, threatening and interfering with the plaintiff’s private life.
