Court of Appeal sitting in Akure has struck out Stay of Execution motion filed by the Appellant, Prince Idowu Adediwura and others on the ruling of the lower court on Obalufe of Ife stool.
Also, it struck out the motion filed by the counsel to the respondent Prince Elugbuji Abayomi on the application for time abridgement of time.
The appellant had in a motion filed at the Court of Appeal sought for Stay of Execution of the ruling of an Osun State High Court sitting in Osogbo, pending the determination of the substantive suit.
However, the applicant, Prince Abayomi had also in a suit filed at the Osun State High Court sought an order restraining the second respondent, Prince Adediwura from parading himself as Obalufe.
Also, an order setting aside the selection/appointment of the second respondent, Prince Adediwura as Obalufe as well as his installation by the first respondent, the Ooni of Ife HRM, Oba Adeyeye Ogunwusi.
The respondent in the suit, Prince Adediwura filed a stay of execution on these orders.
But Justice Akanbi in his ruling delivered on the 11th day of December 2019 dismissed it.
Similar motion for Stay of Execution which was later withdrawn by the counsel to the appellant was filed at the Court of Appeal sitting in Akure.
Justice F.O. Omoleye led three male Justices of the Court of Appeal to strike out the motion sequel to the request of the counsel.
