Justice M.L Owolabi of the Oyo State High Court sitting in Ibadan, has set aside the appointment and installation of Mr Muili Oluwole Oladeji as the Mogaji Agbon of Agbon family compound, Gegelose Agbeni in Ibadan.
The Court also restrained the Olubadan of Ibadanland, Oba Moshood Olalekan Balogun and the Olubadan-in-Council from appointing, installing or recognising Mr. Muili Oluwole Oladejo as the Mogaji of Agbon
Onilabu family pending the hearing and determination of the suit before it.
Justice Owolabi was giving ruling in a suit delineated I/1152/2022 filed by Alh. Waheed Gbolagade Kosoko, the Mogaji of Onilabu family, Gegelose, Agbeni, Ibadan against the Olubadan of Ibadanland, the Olubadan-in-Council and Mr Muili Adewole Oladeji on behalf of himself and other members of the family.
The court in its ruling held that it is the considered view of the court that self help has no place in the civilised world as it is clearly against the rule of law in a democracy.
“It is an act of a brazen act of disrespect and disregard of the
processes of the court and a slap in the face of the court. It is my considered view that having disregarded the processes of the court by installing the third defendant with utter disregard to the processs of the court, the proper order of this court in the circumstance, is to restore status quo by setting aside the appointment of the third defendant.
“I hereby set aside the appointment and
installation of Mr. Muili Oluwole Oladejo by the Olubadan of
Ibadan Land and Olubadan-in-Council on 17th December, 2022 as the Mogaji of Agbon Onilabu family which was done with utter disregard to the processs of the court,” the court held.
