57-year-old arraigned over frivolous petition, false testimony

A 57-year-old man, Dapo Davies has been arraigned on a two-count charge bordering on writing a frivolous and unwarranted petition at the Task Force Unit of Oyo State Real Properties Protection Law, State Secretariat, Agodi, Ibadan and giving false testimony before Magistrate M. Olasimibo of the Oyo State Chief Magistrates Court sitting in Ibadan.

In the charge filed against him by the Attorney General of Oyo State, he was alleged to have given false testimony under oath for the purpose of instituting judicial proceeding against another individual.

The charge read: “That you Dapo Davies on 23rd July, 2024 at the Task Force Unit of Oyo State Real Properties Protection Law, State Secretariat, Agodi, Ibadan in the Ibadan Magisterial District did write a frivolous and unwarranted petition to the aforementioned Task Force Unit knowing such claims contained in the petition to be false and thereby committed an offence contrary to and punishable under Section 12 of the Real Properties Protection Law of Oyo State, 2016.

“That you Dapo Davies on 23rd July, 2024 at the Task Force Unit of Oyo State Real Properties Protection Law, State Secretariat, Agodi, Ibadan in the Ibadan Magisterial District did knowingly give false testimony under oath for the purpose of instituting judicial proceeding against Kamilu Orotoye and thereby committed an offence contrary to Section 87 and punishable under Section 88 of the Criminal Code Law of Oyo State, Cap 38, Laws of Oyo State.”

He pleaded not guilty to the charges and Magistrate Olasimibo granted him bail in the sum of one million naira and two sureties in like sum.

The court also ordered that the addresses of the sureties must be verified and they must be gainfully employed.

The matter was adjourned till January 9, 2025 for hearing.
