Court sentences three persons to death by hanging over armed robbery, culpable homicide

Three Persons have been convicted and sentenced to death by hanging after they were found guilty on two counts of armed robbery and culpable homicide. 

Justice Maimuna Aminu Abubakar of the Minna State High court No 6 who handed down the sentence on the accused persons, said the prosecution counsel had proved the ingredients of the two count charges against the three convicts. Bashar Ibrahim, Aliyu Ibrahim and Suleiman Mamuda who were on the 12 of April 2022, had formed a common intention among themselves to commit the offence of culpable homicide, causing the death of Hassan Shehu who was stabbed with a Knife on the chest and neck.

The trial Judge added that “this was done with the intention of causing his death, and that you thereby committed an offence punishable under section 221 of the penal code law, Cap 94 laws of Niger state 1989 to be read with section 79 of the penal code law Cap 94 law of Niger state 1989”.

Handing down the sentence, he said,  “That you Bashar Ibrahim, Aliyu Ibrahim and Suleiman Mamuda all of New York Tudun Fulani area of Bosso Local government within  the Jurisdiction of this Court attacked one Hassan Shehu  while armed with  a Knife, robbed him of one Peugeot 206 car red in colour, one iPhone, one small techno phone and a cash sum of Three million, Five Hundred thousand Naira(N3.5 million)  and you thereby committed an offence punishable under section 1 (2) (a) and (b) of the robbery and Fire Arms Act”

During the trial, the Prosecution counsel, Barrister Isah Adamu Evuti,  Assistant Chief State counsel in the office of the Attorney General in the Ministry of Justice called seven witnesses and tendered seventeen (17) exhibits to prove his case.

After analyzing the exhibits and the evidence before the court, the trial judge Justice Maimuna Aminu Abubakar was convinced beyond reasonable doubt that the prosecution counsel was able to establish the ingredients  of the two-count charge of culpable homicide and armed robbery against the three convicts.”

Speaking further, he said ” In the final analysis and in the light of the totality of the evidence adduced by the prosecution, I make the following findings, “That on the 12th day of April 2022, the convicted persons connived among themselves, lured the deceased Hassan Shehu (Alias  Wanna), into the room of the third convict  Suleiman Mamuda and stabbed him on his chest with a sharp knife as a result of which the victim bled to death on the spot”.

“That the third convict after killing the deceased robbed him,  while armed with knife and carted away with the deceased’s money in  the sums of N3.5 million and the deceased’s Peugeot 206 vehicle red in colour,  iPhone and small techno phone”  he stated further

“I hereby find as a fact that the Prosecutor has proved all the ingredients of the two count charges against all the convicts.  I, therefore, find the accused persons guilty of the two count charges of culpable homicide and armed robbery and convict them accordingly,” 

“You Bashar Ibrahim,  Aliyu Ibrahim and Suleiman Mamuda hereby convicted and sentenced to death by hanging until you are dead, may the Lord have mercy on your souls”  Justice Maimuna Aminu Abubakar ruled.
